Participant Waiver & Assumption of Risk

Welcome to Garden State Golf Company!

We're excited to have you participate in today's event. Our goal is to provide a safe, fun, and memorable experience for everyone.

Before using the golf simulator, please review the information below and complete the participant waiver form. If you have any questions, please speak with a Garden State Golf Company team member before participating.

Safety Reminders

For everyone's safety, please remember:

• Only one golfer is permitted in the designated hitting area at a time.

• Always remain behind the golfer while they are swinging.

• Never walk in front of someone holding a golf club.

• Only swing when the hitting area is completely clear.

• Follow all instructions provided by Garden State Golf Company staff.

• Children must be supervised by a parent or legal guardian.

• Anyone acting in an unsafe or reckless manner, or who appears impaired or intoxicated to a degree that may make participation unsafe, may be refused participation or removed from participation at the sole discretion of Garden State Golf Company.

Participant Waiver

By participating in activities provided by Garden State Golf Company, I acknowledge and agree to the following:

I understand that participation in golf simulator activities involves inherent and other risks, including but not limited to being struck by a golf club or golf ball; slips, trips, and falls; contact with other participants, guests, simulator equipment, cords, mats, screens, or the inflatable enclosure; equipment movement or malfunction; and other risks associated with golf and recreational sporting activities.
I voluntarily choose to participate and knowingly assume the ordinary risks associated with my participation.
I certify that I am physically able to participate and understand that I am responsible for determining whether participation is appropriate for me.
I agree to use the equipment only as instructed, remain within designated participant areas, and refrain from conduct that could create an unreasonable risk of injury to myself or others.
I agree to follow all safety instructions provided by Garden State Golf Company staff at all times.
I understand that Garden State Golf Company reserves the right to refuse or discontinue my participation if I fail to follow safety instructions, engage in unsafe or reckless conduct, or appear impaired or intoxicated to a degree that may make participation unsafe.
To the fullest extent permitted by applicable law, I release and hold harmless Garden State Golf Company, its owners, employees, contractors, and representatives from claims arising out of ordinary negligence related to my participation. This release does not apply to liability that cannot legally be waived under applicable law, including gross negligence, reckless conduct, or intentional misconduct.
I understand that all golf simulator equipment remains the property of Garden State Golf Company and agree not to intentionally misuse, alter, tamper with, move, or damage any equipment.
If I am signing on behalf of a participant under the age of 18, I certify that I am the participant's parent or legal guardian and have the legal authority to execute this waiver on their behalf.
I understand that photographs or videos may be taken during the event. I may separately choose whether to allow Garden State Golf Company to use images or video containing my likeness for promotional, website, and social media purposes.
